$3 Million Deal Ends a Holdout in Brooklyn

For the past six years, Daniel Goldstein has been at the center of just about every rally, house party,
concert and lawsuit opposed to the $4.9 billion Atlantic Yards project near Downtown Brooklyn.
He wielded a bullhorn and had a lightning-fast e-mail response to every incursion by the developer
Bruce C. Ratner on the 22-acre project site at Atlantic and Flatbush Avenues. As the project
advanced, and every one his neighbors abandoned his building on Pacific Street, Mr. Goldstein
remained with his wife and child, vowing never to be dislodged from their seventh-floor
condominium.
But on Wednesday afternoon, Mr. Goldstein, the last residential holdout in Mr. Ratner’s way, agreed to
walk away from his apartment by May 7 for $3 million. Mr. Goldstein, 40, also agreed to step down as
spokesman for Develop Don’t Destroy Brooklyn, the main group opposing Atlantic Yards. And he said
he would withdraw from any litigation and not “actively oppose the project,” although he said he held
on to his First Amendment rights.
“There’s no end to the criticism and opposition to the project,” Mr. Goldstein vowed.
Still, the settlement marked the end of a David-versus-Goliath fight that has captivated Brooklyn for
years — or, depending on one’s position on the issue, thwarted its progress. Councilwoman Letitia
James, a longtime ally of Mr. Goldstein’s, said that some opponents of Atlantic Yards “will obviously
be disappointed, but not dissuaded” from fighting the project.
Mr. Ratner, the chief executive of Forest City Ratner, was elated. The developer has started work on a
$1 billion basketball arena for the Nets, the centerpiece of Atlantic Yards, and has the right to build 16
towers with up to 6,000 apartments, office space and a hotel. At least 30 percent of the units are for
tenants with moderate or middle incomes.
“Forest City Ratner has from the start worked very hard to compensate and to assist residents who
owned or rented homes in the footprint,” said Joe DePlasco, a spokesman for Forest City. “They made
that commitment at the start of the project over six years ago and today are very pleased that as
construction is in full force they were able to accomplish that goal.”
Bertha Lewis, a housing advocate who supported the project, bid Mr. Goldstein “good riddance.”
“Low- and moderate-income people had to wait years for housing while he obstructed the Atlantic
Yards project,” she said.

�Forest City announced on Tuesday that it had reached agreements with the seven other remaining
families or businesses at the site. Renters were given the option of moving into a building at Atlantic
Yards when it opened (with the developer covering the difference in rent during the interim) or
taking a lump sum payment that averaged $80,000, plus $5,000 for relocation.

Acknowledging the inevitability of eviction, the manager of Freddy’s Bar, a favorite watering hole for
opponents of the project, announced this week that the tavern would close at the end of the month.
Patrons had vowed to chain themselves to the bar, but the manager, Donald O’Finn, told reporters
that he had grown tired of the uncertainty over the saloon’s future. Freddy’s Bar has found a new
home on Fourth Avenue, near Union Street.
In 2004, Mr. Goldstein, a Web designer, helped found Develop Don’t Destroy Brooklyn, one of the most
creative and resilient community activist groups in the city. It raised hundreds of thousands of dollars
from 5,000 donors. Mr. Goldstein helped build a coalition of 21 groups that said the project’s high-rises
and density would overwhelm the neighborhood and make its clogged streets virtually impassable.
Although the group’s lawsuits have proved futile, Develop Don’t Destroy was able to delay Atlantic
Yards for three years after the project gained initial government approval in 2006.
After courts upheld the state’s right to use eminent domain on behalf of Forest City, Mr. Goldstein,
who bought his apartment for $590,000 in 2003, was offered $510,000.
On Wednesday, both sides went before Justice Abraham G. Gerges, who urged them to come to terms.
According to an executive who was briefed on the negotiations but was not authorized to discuss it
publicly, Mr. Goldstein initially sought $5 million. Mr. Goldstein denied that.
The developer, in turn, wanted to prohibit Mr. Goldstein from talking about the project. In the end, Mr.
Goldstein agreed not to file any lawsuits or to initiate any protests, but retained the right to attend
events and to keep criticizing Atlantic Yards.
Although Forest City — which was the development partner of The New York Times in its Midtown
Manhattan headquarters — could have waited for a ruling that might have netted Mr. Goldstein far
less, removing him from the site allows the developer to move forward with demolition and
construction. The developer is paying $6.7 million a month in finance and other overhead costs,
according to court filings.

�Mr. Goldstein said that a “big chunk” of the money would go to his lawyers. Michael Galinsky, a
filmmaker who is making a documentary about Mr. Goldstein and Atlantic Yards, said it would have
been “irresponsible” not to have settled. “It was either move out in two weeks or move out in two
months and take what the state offered,” he said.
A bartender at Freddy’s, Mike Sternfeld, said that under the circumstances, it would be difficult to
criticize Mr. Goldstein. “He’s given up everything to do this over the last six or seven years,” Mr.
Sternfeld said. “He has no block left. He has a family to look out for.”
